This Acceptable Use Policy ("AUP") is incorporated into, and forms part of, the Z360 Terms of Service between Customer and Z360BIZ LLC ("Z360") (the "Agreement"). Capitalized terms not defined in this AUP have the meaning given to them in the Agreement.
This AUP applies to all Customers and users of the Services, including the Z360 web application, mobile applications, web chat widget, forms, and AI teammate. You are responsible for your users and for any action the AI takes under Approved Abilities you enable.
1. General
To keep the Services running safely and lawfully, you agree not to engage in, or permit or encourage anyone else to engage in, any of the following activities.
- You must not use the Services for any illegal purpose, violate any applicable law or regulation, or help anyone else do so.
- You must not collect, store, or share personal information without the notice and consent that applicable law requires.
- You must not impersonate any person, business, or government agency, or misrepresent your identity or the origin of any message.
- You must not commit fraud, phishing, or scams, including sending fake invoices, prize notices, or requests for passwords or payment details.
- You must not infringe any copyright, trademark, privacy, or publicity right, including by cloning a voice without the speaker's consent.
- You must not harass, threaten, or intimidate anyone.
- You must not access accounts, data, or systems that you are not authorized to use.
- You must not probe, scan, or test the security of the Services without our written permission.
- You must not overload the Services, bypass rate limits, usage limits, or fair-use limits, or interfere with other customers' use of the Services.
- You must not reverse engineer, copy, or resell the Services, except as permitted by the Agreement.
- You must not share logins or use a single login for more than one person.
- You must not use the Services to build a competing product.
2. Messaging and Calling
In addition to the restrictions in Section 1, the following rules apply when you use messaging and calling features.
- You must not send texts, make calls, or send emails to anyone who has not given the consent required by law. This includes prior express written consent for marketing texts and for marketing calls that use AI or prerecorded voices.
- You must not use purchased, rented, scraped, or shared contact lists.
- You must not contact anyone who has opted out. Z360 blocks further texts and calls to a contact after they reply STOP or a similar keyword, and you must not work around this.
- You must not send messages that do not match the use case you registered with carriers.
- You must not use number rotation, snowshoeing, or other techniques to evade carrier filtering.
- You must not place calls or send marketing texts outside the hours permitted by law.
- You must not send threatening, hateful, sexually explicit, or harassing content.
- You must not run robocall campaigns or high-volume dialing designed to overwhelm people or networks.
- You must not spoof caller ID or call from numbers that you are not authorized to use.
- You must not call emergency lines or other protected numbers for non-emergency purposes.
- You must not use the AI voice agent to deceive people about who they are speaking with where the law requires disclosure.
Our Messaging and Calling Terms contain additional requirements for these features.
3. Restricted Content
You must not send or store content through the Services that promotes or involves any of the following.
- Illegal drugs are prohibited, as are cannabis and CBD where carriers prohibit them.
- Illegal gambling is prohibited.
- The sale of weapons or explosives is prohibited where the law or carrier rules forbid it.
- Adult sexual content is prohibited, and any content that exploits minors is strictly prohibited.
- High-risk financial offers, such as payday loans, debt relief, or get-rich-quick schemes, are prohibited where carriers prohibit them.
- Hate speech and content that incites violence are prohibited.
- Malware, viruses, and links to them are prohibited.
Carrier rules for messaging change frequently and may be stricter than the law. Messages that violate carrier rules may be blocked by the carrier.
4. AI Features and Integrations
The following rules apply when you use AI features and integrations.
- You must review what your Approved Abilities are permitted to do and supervise their use.
- You must not use the AI to make decisions that legally require a human, or to provide medical, legal, or financial advice without human review.
- You must use connected apps, custom actions, and MCP servers only in accordance with those services' terms.
5. Health Information
You must not submit protected health information ("PHI") to a standard account.
In a HIPAA organization, you may use PHI only with the services covered by your BAA. You must not submit PHI to web search or research features, external apps and integrations, or AI voices marked as not covered.
6. Remedies
A violation of this AUP is a violation of the Agreement. Without limiting any other remedies available to us, if we believe you have violated this AUP, we may take any of the following actions, with notice where practical.
- We may remove content or block messages or calls.
- We may suspend phone numbers or messaging campaigns.
- We may suspend users or your organization.
- We may terminate your account under the Terms of Service.
- We may report illegal activity to the relevant authorities or carriers.
We may act without notice where necessary to protect people, the Services, or our carrier relationships. You are responsible for any carrier fines or fees caused by your violations.
7. Reporting Abuse
To report spam, abuse, or a suspected violation of this AUP, please email help@z360.biz. Please include the phone number or account involved, the date and time, and a description of what happened.
8. Changes
We may update this AUP from time to time. We will post the updated version with a new effective date and notify customers of material changes.
